These Terms of Use govern your use of ark-am.com (the "Site"), operated by Ark-am LLC, a Georgia limited liability company ("Ark-am", "we", "us"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

The Site provides general information about Ark-am and its software development services. Nothing on the Site is a contractual offer to provide services. Any engagement with Ark-am is governed solely by a separate written agreement signed by both parties.

Projects, client names, logos and screenshots appear with permission of the relevant clients or are shown using sample data. Client names and logos are trademarks of their respective owners, and their appearance does not imply endorsement of the Site's other content. Past projects do not guarantee similar results.

The Site and its content, including text, graphics, logos and code, are owned by Ark-am or its licensors and protected by U.S. and international law. You may view and print pages for personal, non-commercial use. You may not copy, modify, distribute or create derivative works from Site content without our prior written permission.

You agree not to use the Site unlawfully; attempt to gain unauthorized access to the Site or its systems; interfere with its operation, including through malware, scraping that burdens our systems, or denial-of-service activity; or impersonate Ark-am or any other person.

Our Privacy Policy explains how we handle information collected through the Site.

The Site links to and embeds third-party services, such as Google Maps and social media platforms. We do not control and are not responsible for their content or practices.

The Site is provided "as is" and "as available." To the fullest extent permitted by law, Ark-am disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components.

To the fullest extent permitted by law, Ark-am will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site. Ark-am's total liability for any claim relating to the Site will not exceed one hundred U.S. dollars (US$100). Nothing in these Terms limits liability that cannot be limited under applicable law.

You agree to indemnify Ark-am against claims, losses and expenses, including reasonable attorneys' fees, arising from your violation of these Terms or misuse of the Site.

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-laws rules. Any dispute relating to the Site will be brought exclusively in the state or federal courts located in Cobb County, Georgia, and you consent to their jurisdiction.

We may update these Terms by posting a revised version with a new effective date. Changes apply from that date forward.

If any provision is found unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. These Terms and our Privacy Policy are the entire agreement regarding your use of the Site.
